Terms and Conditions for Donors and Other Users

In this document:

• “Masjid Assyakirin” refers to Masjid Assyakirin and includes its officers, directors, agents, volunteers and employees.
• “User” refers to any donor, consumer and/or third party using the online portals, websites or services.

1. Donation Amount

There is a minimum donation amount of SGD 5 and a maximum donation amount of SGD 3,000. All donations must be made in whole Singapore dollar amounts, without cents.

2. Payment Methods

Donation transactions must be made using the payment methods specified by the relevant online portal, including, without limitation, the accepted types of debit cards, credit cards or bank payment methods.

3. Donation Categories

Donations made under Masjid Assyakirin’s various donation schemes shall be applied only to the selected donation category. Donations may not be substituted or transferred to another donation category.

4. Non-Refundable Donations

All donations are non-refundable.

5. Use of Donations

Masjid Assyakirin does not warrant that donations will be used for any particular purpose unless expressly stated otherwise. After a donation has been made, all further dealings shall be solely between the donor and Masjid Assyakirin.

6. Purchases and Delivery Charges

For all purchases made through the website, the consumer shall provide a delivery address when confirming the order.

The consumer shall bear and pay to Masjid Assyakirin:

a) All applicable delivery and shipment charges; and

b) Any delivery, re-delivery, forwarding, shipment, re-shipment, administrative costs, taxes, duties, storage charges and disposal charges relating to any item rejected by the consumer, where such rejection is not made pursuant to an express right of the consumer under these Terms and Conditions, or where delivery to the consumer is unsuccessful for any reason.

7. Delivery Address and Re-Delivery

Masjid Assyakirin shall deliver the package or packages to the delivery address provided by the consumer and accepted by Masjid Assyakirin.

Where no person is available to receive the package, additional charges may apply for re-delivery.

Consumers should provide a valid contact number together with the delivery address during checkout so that the courier may contact them in the event of unforeseen circumstances.

8. Estimated Delivery Dates

Any shipment or delivery dates provided by Masjid Assyakirin are estimates only and shall not form part of the contract.

Masjid Assyakirin shall not be liable for any loss, damage or costs incurred where unforeseen circumstances cause a delay or failure to meet any estimated shipment or delivery date.

9. Personal Data

Any Personal Data, as defined under the Personal Data Protection Act 2012, provided by a User to Masjid Assyakirin shall be handled in accordance with the applicable privacy policy and Singapore’s personal data protection requirements.

10. Restriction of Access

Masjid Assyakirin reserves the right, at its sole discretion, to deny or restrict access to its online portals, websites or services to any party at any time.

11. Modification, Suspension or Discontinuation

Masjid Assyakirin reserves the right, at its sole discretion, to modify, suspend or discontinue, temporarily or permanently, any online portal, website or service at any time.

This right may be exercised without prior notice for reasons within or beyond Masjid Assyakirin’s control, including, but not limited to, internet, email, network, computer hardware or software malfunction, failure, damage or delay.

12. Prohibited Use

The User agrees not to decompile, reverse-engineer, modify, reproduce, compile or commercially exploit any online portal, website or service belonging to Masjid Assyakirin.

The User shall also not allow any third party to access or use such online portals, websites or services for any unlawful or unauthorised purpose.

13. Availability of Services

The online portals, websites and services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory or otherwise.

The User’s use of the online portals, websites and services is entirely at the User’s own risk.

14. Disclaimer of Warranties

To the fullest extent permitted by law, Masjid Assyakirin does not warrant, and expressly disclaims, any and all warranties, whether express or implied, including, but not limited to:

a) The accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of any online portal, website or service, or any part thereof, including hyperlinks to or services provided by third parties; and/or

b) That any online portal, website or service will be uninterrupted or error-free, that any defect will be corrected, or that it is or will remain free from viruses and/or other harmful elements.

15. Limitation of Liability

To the fullest extent permitted by law, Masjid Assyakirin shall not be liable to any User for the failure of any service, or for any damage or loss of any kind arising from or connected with the use of an online portal, website or service.

This includes, but is not limited to, special, indirect, consequential or exemplary damages, and any damage or loss arising from:

a) Access to or use of the online portal, website or service;

b) Denial or restriction of access;

c) Modification, suspension or discontinuation of the online portal, website or service; or

d) Any failure to receive or process donations through the online portal, website or service.

16. Technical Failures and Security Threats

Without limiting the generality of the foregoing, Masjid Assyakirin shall not be liable for any defect, default, deficiency or malfunction involving any device, computer, internet service provider, telecommunications system or network.

Masjid Assyakirin shall also not be liable for any viruses, malicious software, denial-of-service attacks or other security threats that may affect the use of its online portals, websites or services.

17. Waiver of Claims

To the fullest extent permitted by law, the User agrees that the use of any online portal, website or service is subject to the User waiving any right to bring a claim against Masjid Assyakirin for damages or losses arising from or relating to such use.

18. No Waiver

No failure or delay by Masjid Assyakirin in exercising any right under these Terms and Conditions shall operate as a waiver of that right.

19. Headings

The headings in these Terms and Conditions are included for ease of reference only and shall not affect their construction or interpretation.

20. Severability

If any provision of these Terms and Conditions is held to be unlawful, invalid or unenforceable, that provision shall be severed without affecting the validity or enforceability of the remaining provisions.

21. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Singapore.

The User agrees to submit to the exclusive jurisdiction of the courts of Singapore.

22. Rights of Third Parties

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of their provisions.

23. Changes to These Terms and Conditions

Masjid Assyakirin reserves the right, at its sole discretion, to amend these Terms and Conditions from time to time.

No other amendment shall be valid unless it is made in writing and signed by a duly authorised officer or representative of Masjid Assyakirin.

24. Acceptance of Terms

The use and/or continued use of Masjid Assyakirin’s online portals, websites or services constitutes the User’s agreement to be bound by these Terms and Conditions, as amended from time to time.

Users who do not agree to these Terms and Conditions should not access or use the relevant online portals, websites or services.
